Limited One-Year Warranty/Guarantee – USB Media

Rimage USB media is guaranteed to pick, clamp, record, and print properly when used with Rimage ribbons, ink, and systems in accordance with Rimage’s written instructions and specifications. This warranty applies only to the original purchaser of the USB media. Rimage will repair, replace, or refund any USB media that fails to perform in accordance with this warranty during the one-year warranty period, which is measured from the date of the applicable invoice. You must pay shipment costs for USB media returned to Rimage. Rimage will pay ground service shipment costs for USB media shipped to you. The minimum number of USB media units that may be returned to Rimage for replacement is 25; however, this 25-unit minimum may be combined across multiple lots or shipments.

Rimage warrants that its USB media is free from defects in materials and workmanship, subject to the terms and conditions set forth herein. Subject to the limitations below, Rimage will, at its sole option, repair, replace, or refund any USB media that proves defective due to improper workmanship or materials. Repaired or replacement USB media will be provided by Rimage on an exchange basis and may be either new or recertified at Rimage’s discretion. Recertified USB media will be tested to ensure that they are functionally equivalent to new USB media. If Rimage is unable to repair or replace the USB media, it will refund or credit the lesser of (i) the current value of the USB media at the time the warranty claim is made or (ii) the original purchase price.

This limited warranty applies only to USB media that is used exclusively in conjunction with Rimage ribbons, ink, and systems and that has not been tampered with, intentionally or negligently damaged, misused, or modified in any respect. It does not cover USB media that fails to pick, clamp, record, or print properly due to shipping damage, accidents, improper handling, improper environment or site conditions, water, dirt, improper storage, or failure to maintain or clean the printer according to Rimage’s specifications; or other reasons beyond Rimage’s control. This limited warranty shall not apply if: (i) the USB media was not used in accordance with Rimage’s instructions; (ii) the USB media was not used for its intended function; or (iii) the USB media is written or printed with incorrect data or labeling due to operator error or third-party software. Rimage will determine, in its reasonable discretion, whether the USB media has failed due to a defect or for a reason excluded from this warranty.

This limited warranty covers only the repair, replacement, or refund of defective USB media, as expressly provided above. These remedies are the exclusive remedies available under this warranty. Rimage is not liable for any other damages, including indirect, incidental, consequential, special, or punitive damages, or for any loss of, damage to, or corruption of content or data, or any costs associated with determining the source of system problems, or removing, servicing, or installing Rimage products. This warranty does not cover third-party software, connected equipment, or stored data, and Rimage is not liable for any actual or consequential losses arising from such items. Rimage’s sole and maximum obligation under this warranty shall be to repair, replace, or refund the USB media, as determined by Rimage in its reasonable discretion.

This warranty and any claims arising from it shall be governed by the laws of the State of Minnesota, and any dispute shall be resolved exclusively in the courts of Hennepin County, Minnesota. If any provision of this warranty is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This warranty constitutes the entire warranty provided by Rimage for USB media and supersedes all prior or contemporaneous representations or agreements, whether written or oral.
